ACCEPTABLE USE POLICY

A. Unacceptable Use

86Borders requires that all customers and other users of 86Borders’ cloud-based platform services (the “Services”) conduct themselves with respect for others. In particular, observe the following rules in your use of the Services:

  1. Abusive Behavior: Do not harass, threaten, or defame any person or entity. Do not contact any person who has requested no further contact. Do not use ethnic or religious slurs against any person or group.
  2. Offensive Content: Do not post any content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts.
  3. Privacy: Do not violate the privacy rights of any person. Do not collect or disclose any personal address, social security number, protected health information, or other personally identifiable information without each holder’s written permission. Do not cooperate in or facilitate identity theft.
  4. Intellectual Property: Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not reproduce, publish, or disseminate software, audio recordings, video recordings, photographs, articles, or other works of authorship without the written permission of the copyright holder.
  5. Hacking, Viruses & Network Attacks; Other Security Violations: Do not access any computer or communications system without authorization, including the computers or software used to provide, use or access the Services. Do not attempt to penetrate or disable any security system. Do not monitor data or traffic on any network or system without permission. Do not intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, time bombs, cancelbots, or other items of a destructive or deceptive nature, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website. Do not forge TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. Do not attempt to access or otherwise interfere with the accounts of other users of the Services. Do not disable, interfere with or circumvent any aspect of the Services.
  6. Spam: Do not generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisings or other solicitations (“Spam”) or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.
  7. Fraud: Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
  8. Violations of Law: Do not violate any law or engage in, promote or encourage illegal activity.
  9. Usage: Every user bears the responsibility for knowing and complying with applicable laws, policies, and rules; for appropriately securing their computers and other electronic devices from misuse or theft by others; and for avoiding any use that interferes with others’ legitimate access to and use of the Services and the 86Borders Platform.

B. Consequences of Violation

We reserve the right, but do not assume the obligation, to investigate any violation of this Acceptable Use Policy (this “AUP”) or misuse of the Services. Violation of this AUP may lead to suspension or termination of the user’s account or use of or access to the Services, or other legal action. The user may also be required to pay for the costs of investigation and remedial action related to AUP violations. In addition, when any use of the Services presents an imminent threat to other users or to 86Borders’ technology infrastructure, or poses a likely violation of the law, 86Borders may, without notice to the user, take whatever steps are necessary to manage the threat and/or preserve and access data, and 86Borders reserves the right to take any other remedial action it sees fit.

We may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Our reporting may include disclosing appropriate customer or user information. We also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this AUP.

C. Reporting Unacceptable Use

86Borders requests that anyone with information about a violation of this AUP report it via e-mail to the following address: notice@86borders.com . Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including e-mail, SMS or IP (Internet Protocol) address if available, as well as details of the violation.

D. Revision of AUP

86Borders may change this AUP at any time by posting a new version on this page and sending the user written notice thereof. The new version will become effective on the date of such notice.
